1. Introduction
Welcome to SA Chalkboard ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the SA Chalkboard website, mobile applications, and educational services (collectively, the "Services"), operated by SA Chalkboard (Pty) Ltd, a company registered in South Africa.
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Services. These Terms apply to all visitors, users, learners, parents, guardians, and others who access or use the Services.
2. Eligibility & Accounts
Age Requirements: You must be at least 13 years of age to use our Services. Users under 18 must have parental or guardian consent and supervision. Parents or guardians are responsible for monitoring their children's use of the platform.
Account Registration: When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
Account Security: You are responsible for safeguarding the password and any other credentials used to access your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Services Description
SA Chalkboard provides an online educational platform offering:
- Interactive lessons aligned with the South African CAPS curriculum
- 3D visualizers and simulations for STEM subjects
- AI-powered tutoring and personalized learning assistance
- Access to past examination papers and practice materials
- Gamified practice missions and progress tracking
- Study tools and collaborative learning features
Access Model: SA Chalkboard does not operate on a recurring subscription basis. Instead, users may pay a single, once-off fee of R99.00 to unlock full, unlimited access to all features available on the platform for a period of 30 days from the date of purchase. There is no automatic renewal or recurring billing of any kind. At the end of the 30-day period, access to premium features simply ends unless you choose to make a new R99.00 purchase to unlock another 30-day period. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
4. Payments & Billing
All payments are processed in South African Rand (ZAR) unless otherwise stated. By providing a payment method, you authorize us to charge the applicable once-off fee to unlock full access.
Once-Off Payment: SA Chalkboard does not offer subscription services. Payment is a single, once-off charge of R99.00 which unlocks all features available on the app for unlimited use over a fixed 30-day access period. Your payment method is not stored or charged again automatically — there is no recurring billing, no auto-renewal, and no ongoing commitment.
Renewing Access: Once your 30-day access period ends, you may choose to make a new R99.00 payment at any time to unlock a further 30 days of full access. Each purchase is a separate, standalone transaction.
Price Changes: We may change the once-off access fee at any time. Any price change will only apply to new purchases made after the change takes effect and will not affect an access period you have already paid for.
Failed Payments: If a payment fails or is not successfully completed, access will not be unlocked and no charge will be applied.
5. Intellectual Property
All content, materials, software, graphics, logos, trademarks, and intellectual property on SA Chalkboard are owned by or licensed to us. This includes but is not limited to lesson content, 3D models, past papers, practice questions, and platform code.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial educational purposes. You may not:
- Copy, reproduce, distribute, or create derivative works from our content
- Reverse engineer, decompile, or disassemble any part of the platform
- Remove copyright or proprietary notices from any materials
- Use our content for commercial purposes without written consent
- Share account credentials or allow multiple users on a single account
6. User Conduct
You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the platform. Prohibited activities include:
- Uploading viruses, malware, or harmful code
- Attempting to gain unauthorized access to systems or data
- Harassing, abusing, or harming other users
- Impersonating any person or entity
- Using automated systems to access the platform (bots, scrapers)
- Sharing inappropriate, offensive, or copyrighted content
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.
All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Limitation of Liability
To the maximum extent permitted by South African law, SA Chalkboard and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.
Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
